Public Information Act Requests

The Texas Public Information Act (TPIA) gives individuals the right to request access to

public information. Texas Government Code 552.002(a) defines “public information” as
information that is written, provided, collected, assembled, or maintained under a law or
ordinance or in connection with the transaction of official business.

 

Blooming Grove ISD, as a local governmental entity, is subject to the requirements of
the TPIA. However, the TPIA does not require Blooming Grove ISD to create new
information or perform legal research. For more information about the Texas Public

should by “Public Information Request” or “Open Records Request.” All requests
must be sent to this email address to ensure compliance with the required
timeframe under the TPIA.

When can I expect a response to my request?


Blooming Grove ISD strives to meet information requests in compliance with state and
federal laws. To the extent possible, requests are handled in the order they are
received. By law, Blooming Grove ISD has ten (10) business days to determine whether
or not to seek an Attorney General’s ruling regarding information that may be exempted
from public disclosure.


Additionally, effective September 1, 2023, Texas House Bill 3033 updated the definition
of a business day under the TPIA. Under the new definition in Texas Government Code
552.0031, a business day is any day other than a Saturday or Sunday, a national
holiday, or a state holiday, including an optional holiday observed by the government
body. The Friday before or the Monday after a state or national holiday is also not a
business day if the governmental body observes the holiday on that Friday or Monday.
A Board of Trustees of a school district may also designate up to ten non-business days
per calendar year.

 

All days not listed below are considered business days for Public Information Act
requests even if BGISD is closed as a district.
